2. PURPOSE (LEGAL NOTICE)

Please read this document carefully. It constitutes the Terms of Use governing the access, browsing and use of the Website www.aldara-ci.es owned by Aldara Construcciones e Infraestructuras S.L.

The access, browsing and use of the Platform / Website implies your express full acceptance of all the terms of this Legal Notice (hereinafter, THE "LEGAL NOTICE"), having the same validity and effectiveness as any contract written and signed. Its enforcement and compliance shall be required by anybody accessing, browsing or using the Platform / Website. 

For the purpose of interpretation of this Notice, we understand that a person becomes a -User- as soon as he/she enters or visits our Website.

In principle, User subscription or registration is not required for using this Website, but in order to use certain services or access certain content, you may be required to previously subscribe or register as a User, in the way we inform you.

The contents of our portal (publications of the various products, promotions and offers) are intended for residents in Spain and are valid in Spanish territory.

And, finally, all Users expressly and unequivocally accept the Legal Notice and Privacy Policy, as well as the different changes and/or any additional legal texts to be included in the future by Grupo Inmobiliario Ferrocarril S.A.. If you do not agree to the terms set forth herein, do not access, browse or use the Platform / Website, being able, where applicable, to unsubscribe from the service at any time. 


3. INTELLECTUAL AND INDUSTRIAL PROPERTY

The contents of the Website www.aldara-ci.es in terms of texts, images, graphic design, source code, logos, trademarks, etc., are the exclusive property of ALDARA CONSTRUCCIONES E INFRAESTRUCTURAS S.L. and are protected by Intellectual and Industrial Property regulations, therefore their reproduction, modification, distribution or manipulation is prohibited.

We are deeply committed to the protection and defence of intellectual and industrial property rights. Therefore, we must inform you that on the basis of applicable legislation: 

• Under no circumstance may it be understood that we give the user any right of exploitation regarding the contents exposed beyond what is strictly necessary for their viewing. 

• We guarantee that all contents we put at your disposal are completely original and in compliance with national legislation in force, all of them being protected by intellectual property rights. In those cases in which we do not own the contents, we have all the rights (transferred) relating to their public disclosure, distribution and/or reproduction. 

• All logos, trademarks and trade names on the Website or Platform are our property or, in the case of the third parties that have transferred/allowed their use and/or exploitation. 

• Under no circumstance may browsing the Website imply the waiver, transmission, license or total or partial transfer regarding the intellectual or industrial property rights, unless otherwise established in writing.

4. CONFIDENTIALITY AND DATA PROTECTION

In accordance with the provisions of Organic Law 15/1999, of 13 December, on Personal Data Protection, all personal data provided during the use of the Website shall be processed in accordance with the provisions set forth in the Privacy Policy and Cookie Policy that must be expressly accepted by every User in order to use and register in the system. 

Users accepting this Legal Notice, accept in an informed manner, expressly and unequivocally, our Privacy Policy and Cookies Policy, being entitled to duly exercise their rights of access, rectification, cancellation and opposition regarding their personal data, as set forth in the mentioned Privacy Policy and Cookies Policy. 


5. RESPONSIBILITIES

We are committed to the proper functioning of the service in accordance with the conditions agreed upon with our Users. However, situations may sometimes arise, especially due to the intervention of malicious third parties, which could lead to liabilities. 

In this regard, below we indicate those situations in which we shall not be held liable for Users' actions, the latter having to assume all the responsibilities arising: 

• In the event of any information being published on the Website or Platform not hosted by us or which may have been published by a third party outside the company. 

• In the event of the Website and Platform not being operational for technical reasons attributable to third parties or unforeseeable reasons or force majeure.

• In the event of the User storing, disseminating, publishing or distributing on the Website any type of defamatory, libellous or discriminatory material inciting violence or against public moral, public order, fundamental rights, public freedoms, honour, privacy or image of third parties. 

• In the event of the User using the Website or Platform for entering data, viruses, codes, hardware or telecommunications equipment or any other instrument or electronic or physical device and causing damage to other User systems. 

• In the event of any of the contents accessible through the Website or Platform being contrary to the regulations in force, we undertake to proceed with their immediate withdrawal as soon as we have effective knowledge and verify the facts. (When accompanied by the resolution of the competent authority referred to in Article 16.1 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.) 


6. RESOLUTION OF DISPUTES

For any legal dispute or matter concerning our Website or any depending on it, Spanish legislation shall apply, the Courts and Tribunals of Madrid being competent for resolving all the conflicts arising from or related to the use of this Website, provided the applicable legislation does not expressly state that it depends on the courts or tribunals of another jurisdiction. 

Any complaints regarding the use of our services can be submitted by mail to the electronic or physical address indicated above.


7. COMMERCIAL NOTE

The information collected on this Website does not constitute a contractual document: the forms, colours, dimensions of the buildings, as well as the ground levels, and, in general, all the commercial information, details and characteristics given, come from a preliminary draft of the development and its validity is conditional upon the determinations of the works license to be granted with the blueprints and other permits and administrative qualifications, as well as the drafting of the Final Execution Project. The interested party shall be aware of the variations that may be applicable at any given time through the information provided with the contracting and the complementary documentation.

The information to be provided and at the disposal of the interested parties, in accordance with Law 2/1999, of 17 March, on building quality measurements, and Royal Decree 515/1989, of 21 April, is available at our offices and/or at the sales office on the development site. 

From the start of construction, information shall be provided regarding the documentation relating to the document verifying readiness for construction and the licenses and authorisations required to begin the works and all the documents that will make up the Book Building during construction, which shall be delivered in its day to the representation of the Residents' Association. 

The participation quotas in the building's common expenses shall be those contained in the Declaration of New Building and Horizontal Division, quotas which shall be determined in accordance with the criteria established in the corresponding provisions of the Horizontal Property Law.

Contracts signed shall not include arbitration agreements. Companies and professionals taking part in the building, without there being any commitments between them for which they are jointly and severally liable, are responsible for the good construction and quality in accordance with the Law.
